The present General Conditions regulate the acquisition of the products offered in the web site www.delapura.com, of which NOVATURE HERBAL S.L. (from now on, NOVATURE) is the owner.
The acquisition of any of the products entails the full and unreserved acceptance of each and every one of the General Conditions that are indicated, without prejudice to the acceptance of the Particular Conditions that could be of application when acquiring certain products.
These General Conditions may be modified without prior notice, therefore, it is advisable to read carefully its content before proceeding to the acquisition of any of the products offered.

All notifications and communications between users and NOVATURE will be considered effective, for all purposes, when made through any of the means detailed above.
The products offered, along with the main characteristics of the same and their price appear on screen.
NOVATURE reserves the right to decide, at any time, the products and / or services offered to customers. Thus, NOVATURE may, at any time, add new products and / or services to those currently offered. Also NOVATURE reserves the right to withdraw or stop offering, at any time, and without notice, any of the products offered.
Once inside www.delapura.es, and to accede to the hiring of the different products, the User will have to follow all the instructions indicated in the process of purchase, which will suppose the reading and acceptance of all the general and particular conditions fixed in www.delapura.es.
- AVAILABILITY AND SUBSTITUTIONS
NOVATURE intends to guarantee the availability of all products that are advertised through www.delapura.com. However, in the event that any requested product is not available or if it is out of stock, the customer will be informed by email as soon as possible.
If the product is not available, and having been informed of this the consumer, NOVATURE may provide a product of similar characteristics without price increase, in which case, the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract.
In case of unavailability of all or part of the order, and the rejection of replacement products by the customer, the refund previously paid, will be made by the same means of payment you used in your purchase.
If NOVATURE is unjustifiably delayed in returning the amounts paid, the consumer may claim double the amount due.
- PURCHASING AND/OR CONTRACTING PROCESS
To make any purchase at www.delapura.com, the customer must be of legal age.
The steps to follow to make the purchase are:

The customer will be able to modify or confirm his order by accessing the shopping cart.
The customer may request a copy of the invoice at any time by the usual means of contact.
It is also recommended that the customer prints and/or keeps a copy on a durable medium of the conditions of sale when placing his order, as well as the receipt sent by NOVATURE by email.
In his user account, the customer will be able to access his previous purchases. He can also request a copy through our email.
Together with your order, you will receive the corresponding invoice.
The order will be delivered to the address designated by the customer at the time of contracting according to the chosen method.

FORMS AND TERMS OF DELIVERY
- Shipment by Correos España or transport agency:
Our products are handmade or customized, the customer will be informed in the product sheet, or by means of communication from us of the manufacturing and shipping deadlines in each specific case.
The maximum delivery time for products in stock is 7 working days. In any case, the terms will vary depending on the periods of preparation of the same, the customer will be informed of the status of your order at all times.
Remember that there must be someone at the shipping address during the delivery times of Correos España or the Agency, in any case it will be during business hours. You can also indicate an address of someone you trust, office or business where to deliver the order.
- PRICES, EXPENSES AND TAXES
The prices of the products listed in www.delapura.es will be expressed in Euros unless otherwise stated and will be guaranteed for the time of validity of the same, except for printing errors and whatever the destination of the order.
The final prices of all the products, (and in its case, the final prices by unit of measurement, when it is obligatory) next to its characteristics, the offers, discounts, etc., are reflected in each one of the articles that appear in the catalog of www.delapura.com.
VAT is included in the products.
The VAT rate is 21%.
Shipping costs (Taxes included):
- For mainland Spain the shipping costs are 3 Euros.
- For Ceuta and Melilla the shipping costs per order are 15 Euros.
- For the Balearic Islands, Santa Cruz de Tenerife, Las Palmas the shipping costs are 10 Euros.
- For Portugal the shipping costs are 8 Euros.
- For Spain the shipping costs are 10 Euros.
For the rest of the territories, the customer will be informed of the shipping costs and delivery times after consultation with email@example.com, as soon as possible.
The prices of the products may vary at any time. In this case, the price to be applied will be the one in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before it formalizes its acceptance.
We offer you the following payment methods:
- By credit or debit card.
You can make the payment immediately through the SSL secure payment gateway of our Bank. If it is necessary to make any refund or cancellation of the order, the amount will be refunded through the same payment card.
Both personal and bank data will be protected with all the security measures established by the Organic Law of Data Protection 15/1999 and its Development Regulation with total confidentiality.
- Bank Transfer
If you select bank transfer as payment method, you will receive an e-mail with the order confirmation, departure date, amount to be paid and the account number to which you must make the bank transfer. It is very important that you indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days from the day you place the order in order to validate it. The order will not be considered effective until you send by e-mail firstname.lastname@example.org the receipt of the transfer and it is effectively confirmed by our bank that the payment has been made. Do not forget that you must make the payment in euros and that all possible exchange and bank commissions are your responsibility when you choose this payment system.
- RETURN AND CANCELLATION POLICY
According to the regulations, the consumer and user shall have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without stating the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the text referred to the General Law for the Defense of Consumers and Users.
This right of withdrawal is not applicable to, among others:
Contracts for the supply of products made in accordance with the specifications of the consumer and user or, clearly personalized, or which by their nature cannot be returned or may deteriorate or expire quickly.
Supply of sealed goods that cannot be returned for health or hygiene reasons.
The customer will have a maximum period of 14 calendar days from the day of receipt of the good or product ordered to inform NOVATURE about their desire to withdraw from the contract.
The withdrawal implies that NOVATURE proceed to refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment (provided that the product purchased is not within the exceptions listed above).
During this period, the consumer will communicate to the entrepreneur his decision to withdraw from the contract by filling out the form at the end of this document and sending it to the email address of NOVATURE.
NOVATURE will communicate to the consumer on a durable medium an acknowledgement of receipt of such withdrawal.
To proceed with the return of a product it is essential that it is in perfect condition and with its original packaging, with all its accessories and without having been used.
Once we receive your request we will contact the customer to indicate the details of the return.
The customer will bear the cost of returning the goods.
Products purchased through www.delapura.com are covered by a 2-year warranty period from the time of purchase, covering any defects in workmanship or manufacture of the product.
For damaged or defective products, the customer should contact us as soon as possible. He/she will be informed of the return or replacement procedure and of the delivery times of the products during the claim process. All costs of warranty care, claims and replacement of products are borne by NOVATURE.
Excluded from the guarantees are consumable products, deficiencies caused by improper use or manipulation or defects resulting from any external cause.

In any case, NOVATURE will attend as soon as possible and within a reasonable period of time the replacement of defective products, respecting the same shipping times as those of the initial order object of the claim.
For second hand products, the warranty period is 1 year; the same procedure must be followed as for new products.
Likewise for second-hand products, the consumer cannot demand replacement.
- LIABILITY AND DISCLAIMER OF LIABILITY
The consumer and user has the right to the repair of the product, its replacement, price reduction or termination of the contract, as established in Chapter II Title IV Book II of the General Law for the Defense of Consumers and Users.
If the product does not conform to the contract, the consumer may choose between repair or replacement of the product, both free of charge for the consumer, which will be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended.
If, once the repair has been completed and the product has been delivered, it is still not in conformity with the contract, the consumer may demand its replacement, a price reduction or the termination of the contract.

- LEGISLACIÓN APLICABLE
The present conditions shall be governed by the Spanish legislation in force.
